California's AI watermark law is now in force: big providers must stamp and detect their own content
The California AI Transparency Act (SB 942) became operative on August 2. Generative AI providers with more than a million monthly users in the state must now embed machine-readable, C2PA-compatible provenance data in AI-generated images, video and audio, offer a free public tool that detects content made by their own systems, and let users add a visible 'AI-generated' label. Violations carry a $5,000 civil penalty each; the AB 853 amendment deliberately aligned the start date with the EU AI Act transparency rules that took effect this week.
Why it mattersThe world's two heaviest regulatory blocks began demanding AI provenance in the same week, which turns invisible watermarking from a voluntary industry standard into a legal requirement. For everyone else it means 'was this made by AI?' slowly becomes a question with a checkable answer.
