Taiwan's Keelung District Prosecutors' Office indicted nine people on Monday over the resale of Supermicro AI servers fitted with Nvidia B300 GPUs to buyers in China. Among the defendants are a distribution manager at Nvidia's own Taiwan office — described by prosecutors as the key figure who authorised release of the chips — two sales managers at Supermicro's Taiwan branch, and the chief executive of a Supermicro distributor. End-user documents claimed the 130 servers would be installed at a rented facility in Taiwan. Seventy-four went to Chinese customers, some shipped directly and some routed through Indonesia, Japan and Hong Kong; customs spotted irregularities and stopped the other 56. Prosecutors are seeking the five-year maximum for four of the nine.

Why it mattersExport controls on advanced chips do not work by inspecting every crate. They work through whitelists, end-user declarations and no-resale clauses — paperwork checked by employees at the vendor and its distributors. This indictment alleges the check failed at exactly that layer, with a manager inside the chipmaker's own office signing off. That is a harder problem than smuggling, because the control system has no fallback when the people operating it are the ones being charged.
