OpenAI got 16 states to sign one privacy contract, and the district paperwork that used to take months collapsed into a checklist

OpenAI is adding 55 US school systems across 20 states to ChatGPT for Teachers, reaching over 100,000 more educators and staff. That brings it to more than 100 K-12 organisations in 30 states and over 300,000 teachers and staff, and includes one in five of America's twenty largest public school districts. The piece that actually moved is legal, not technical: a 16-state National Data Privacy Agreement built on the Student Data Privacy Consortium framework, covering Illinois, Iowa, Maine, Massachusetts, Missouri, Nebraska, New Hampshire, New Jersey, New York, Ohio, Rhode Island, Tennessee, Texas, Vermont, Virginia and Washington. A district in those states now evaluates the product against a shared checklist instead of negotiating its own contract. The tool stays free for verified US K-12 educators through June 2028, districts own and control what is uploaded, and the data is not used to train OpenAI's models. Students have no access; it is a teachers' account.

Why it mattersSchools rarely reject AI on the merits — they stall in procurement, where a small district has no lawyer to read a data agreement. Removing that step is how a product becomes a default rather than a pilot, and it is worth watching whether the states that signed keep the leverage to change the terms later. Note also what OpenAI is buying: three years of free access ending in June 2028 leaves a very large installed base facing its first invoice at the same moment.
